Q: Can I file an English version of my application in China and follow up with a translation?

A: No, all filings in China must be in Chinese. 

Q: My 30-month PCT date is tomorrow and I don't have a Chinese translation of the application yet, what can I do?

A: The Chinese Patent Office (SIPO) provides a two-month extension from the 30-month PCT date to enter into Chinese National Stage with a nominal fee.  No petition needs to be filed for the extension. 

Q: What types of patents are there in China?

A: There are three types of patents in China: invention, utility model, and design.  Invention and design patents are generally similar to utility and design patents in the U.S.  However, utility model patents do not have a counterpart in the U.S.  For more information about the Chinese utility model system, please read more here.
